These terms and conditions apply to orders for purchase placed on this website.

Prices & Delivery
Prices shown on this site are in GB Pounds. Delivery charges are calculated by estimated total weight at the checkout including an amount to cover the costs of processing and packaging. It may be that you are able to select a preference for delivery method at the checkout, however, we may occasionally use an alternative delivery method if it provides equal or better value. Under normal circumstances, items ordered before 14.30 hrs Mon-Fri are dispatched the same day, although no liability will be accepted for delays in either dispatch or delivery.  If the item you have ordered has not arrived after the expiry of 15 working days you should contact us by email and we will dispatch a second item.  We will not enter into any correspondence regarding non-delivered items until 15 working days has passed from the date of of your order.  In any event you should allow up to 28 days for delivery to allow for unforeseen circumstances or delays in the delivery service which may be beyond our control.  Some items may from time to time be listed and described as 'Out of Stock' with an estimate of when new stock is expected.  You can still order goods which are not in stock.  Your payment will be processed immediately in the normal manner.  We do not dispatch orders containing out of stock items until all items within the order are in stock.  The estimated re-stocking period is provided as a guide only and does not constitiute a firm date.  The order will be dispatched automatically when all of the items in your order are available.  We do not part-ship orders containing out of stock items.  Where offered, next day delivery excludes Saturday, Sunday and Bank Holidays. Where offered, UPS delivery is to mainland UK addresses only and may be resticted by UPS service area limitations.  Our products are only available for sale to UK residents aged over 18 for delivery to a UK postal address.


The Contract Between Us

After you have placed your order we will send a confirmation email summarising the items ordered, the delivery method and total cost. If there are any errors you should notify us by email immediately. Once the payment for your order has been confirmed, the goods will be packaged and dispatched by the chosen delivery method. No contract will exist between you and Electricity-monitor.com for the sale of goods by us to you until your credit/debit card has been charged, we have raised an invoice and the goods have been dispatched. This shall be deemed to be our acceptance of your offer and to have been effectively communicated to you. Our contract is to be interpreted and enforced with the laws of England, in its entirety and will be subject to the jurisdiction of the English courts. This does not affect your statutory rights as a consumer. Please note that some of our processes are manual and even with the best of intentions, errors can arise. We carry out frequent checks to detect any errors. If they do occur, we will act immediately to minimise inconvenience and disappointment that may be caused.

Payment Details
Payments are processed online in real-time by LloydsTSB Cardnet through the Protx secure gateway service. All major cards issued by UK banks are accepted. All transactions are encrypted, we never actually see your card details – this is all handled on SSL secure servers via https:// pages. You will see the gold padlock in the corner of your browser confirming that the transaction is secure.

Guarantee
All our products and accessories are guaranteed for a period of one year from the date of purchase. You should retain your receipt/invoice as proof of purchase in the unlikely event that your product develops a fault and requires attention. Our guarantee does not cover batteries, mis-use or negligence.  Products bought as ex-rental are sold as used and carry a 30 day replacement warranty on a like for like basis.

Wireless electricity monitors use radio signals to send information from your meter to the display unit over the busy and unregulated 433MHz frequency. The transmission range stated by each manufacturer is provided as a guide only and will vary dependent upon local environmental factors. We are therefore unable to offer guidance or advice on whether or not a particular brand of monitor will maintain communication under either general or specific circumstances. The 433MHz radio frequency is used by many devices in and around the home and neighbouring properties including wireless doorbells, car remote controls, TV senders, baby monitors, remote power sockets and lighting, alarm systems, toys, etc. It is possible for some of these devices to interfere with the regular signal from the wireless electricity monitor's transmitter unit, causing occasional loss of connection. For this reason, performance and stability of the wireless connection between a monitor's transmitter and receiver is not guaranteed.

We aim to provide outstanding customer service. We are a small family run business and we will do everything we can to resolve any issues you may have in a polite and amicable manner.


Once an order has been placed

Cancellation Rights – orders placed in error
It is advisable that you cancel any orders placed in error by contacting us immediately either by email or telephone on 01225 852123 before they are invoiced and dispatched. Requests for cancellations sent via email may not be actioned for 36 hours in extremely busy periods, which may result in the order being dispatched. Once the goods have been dispatched, your cancellation rights are covered by the distance selling regulations.

Failure to accept delivery of Goods once dispatched
All deliveries require a signature at the agreed delivery address, which means that you will need to be in attendance at the delivery address to accept the goods. Royal Mail will make only one attempt at delivery, after which the goods will be made available for you to collect at your local sorting office on production of ID. Royal Mail will only hold non-delivered items for one week, after which they are automatically returned to the sender. In the event that you do not accept delivery of the goods which you have ordered and we receive them back in as new condition, we will arrange for a refund within 30 days of receipt, less the postage and packaging charge and a 10% re-stocking fee.

Unwanted Goods - Distance Selling Regulations
You may cancel your order within 7 working days from the date you receive the goods. You must notify us by writing or email within 7 working days of receipt and return the unwanted goods to us in perfect condition, unused and in their original packaging at your own risk and expense within 14 days of your order.  Provided that you return the unwanted goods unused and in their original packaging within 14 days of your order, we will credit your payment card with the cost of the unwanted goods minus our delivery charges and packaging costs within thirty days of the date we receive the goods. If the goods have been used or are not in perfect condition we reserve the right to refuse and return them to you at your own expense. If you do not notify us in writing or email within 7 working days that you wish to cancel your order and subsequently return the goods requesting a refund, they will be returned to you at your own risk and expense.  Please note that in some cases delivery charges may have been provided at a promotional rate. In the event that goods are accepted for return, the actual cost of shipping will be applied, which may include additional charges for attempted deliveries where the delivery address was unattended or there was no reply.

Return of Faulty, Incorrect or Sub-standard Products
If any item you receive is faulty, incorrect or damaged in transit, we will replace it free of charge, you must notify us by e-mail within 24 hours of delivery. If we do not receive such notification from you within 24 hours of delivery, the goods are deemed to have been received by you in good working order.

Price Changes
We reserve the right to change prices without prior notification. We will not increase the price of an item you have ordered after you have placed your order unless there was a genuine pricing error.

Pricing Errors
Although we make every effort to ensure the prices on the website are correct, mistakes may sometimes be made. If we discover a mistake in the price of an item you have ordered we will inform you and provide the option of either reconfirming your order at the correct price or cancelling it. If we are unable to contact you or we receive no reply from you, we will cancel the order. If your order is cancelled and you have already paid for the products you will receive a full refund.

Limitation of Liability
We will not be liable to you: For any loss of profit, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the products you ordered which was not within our reasonable contemplation as a probable result of a breach of contract on our part at the time that our contract with you was concluded. Where performance of any obligations to you is prevented, frustrated or impeded by any circumstance or caused beyond our reasonable control.


Upon Delivery of Goods

Seller Liability
The seller does not accept liability for shortages in quantities delivered unless the buyer notifies the seller of any claim of short delivery of the goods within 24 hours of delivery. In such circumstances the seller's liability shall be restricted to making good the shortfall.

Making Returns
Goods may be returned by post or courier by repackaging them securely within their original packaging and delivering them to us at:

Returns are made at your own risk and expense. We recommend that you use an insured registered mail service because returns not received by us cannot be credited to you. Refunds will be credited to your original payment card. We cannot accept liability for any returns which are 'lost' in the post.


If the Goods do not arrive

If your item does not arrive, please be patient. The Royal Mail do not consider a First Class post item 'lost' until 15 working days have passed. This does not happen very often and if an item does not arrive promptly, it is still very likely that it will arrive well within this time frame. If an item is delayed, we cannot take any action until 15 working days have passed. It is not possible to trace postal items once they have been sent, the Royal Mail Recorded Delivery system is intended to provide proof of delivery only, and has no in-transit tracking facility.

If 15 working days have passed since your order date and the goods have not arrived, please email us at dispatch@electricity-monitor.com and we will arrange for a replacement to be sent. Please include the date on which you ordered, a copy of your order confirmation email, and state that the order has not been received. We will use this email as evidence for the investigation and claim that we will make with the Royal Mail and as confirmation of a lost parcel

Statutory Rights

Rental

Rental of Electrisave, Owl or Efergy wireless energy monitors from Electricity-monitor.com implies acceptance of these Terms & Conditions in their entirety.

General terms of rental

The Wireless Energy Monitor rental service is available to UK residential addresses only. Customers should order only if they are over 18 years of age and have a UK based payment facility, eg Debit / Credit card in their own name.

The Wireless Energy Monitor rental service is an offer to rent a single and complete Wireless Energy Monitor (WEM) system for an initial period of 30 days at a fixed rate as advertised. This rate may vary from time to time, but in any event will be clearly stated before payment is made. The customer agrees that the rental will continue at the agreed rate per calendar month or any part thereof until the WEM and complete original packaging materials are returned to the offices of Electricity-monitor.com.

The Customer may elect to purchase the rental WEM at any time before expiry of the rental period at a cost of £24.99 for the Owl/Electrisave brand product or £29.99 for the Efergy brand product. Purchases of rental WEM systems are deemed to be sold as 'used', the guarantee is limited to a 30-day replacement warranty with an equivalent used WEM.

The rental charge does not include return delivery.

Batteries are not included in the rental charge.

The rental WEM will usually be dispatched the same working day for orders placed before 14.30 Mon-Fri although occasionally, during periods of high demand, the dispatch of rental units may be delayed by several days. Once the WEM has been dispatched, the agreement to rent may not be cancelled. Where a delivery choice is offered, we reserve the option to provide an alternative delivery method having equal or better value. The choice of a next working day / timed delivery service does not guarantee same day dispatch. Delivery within advertised time schedules for whichever delivery service is chosen is not guaranteed. We can accept no liability for delays in dispatch or delivery for whatever reason.

The rental period will start from the delivery date but no later than 5 days from the date of dispatch. If delivery fails, or is severely delayed, a facility is available online to report such incident. The rental period will be extended accordingly and the return date amended.

The Customer is responsible for taking reasonable care of the WEM and the supplied original packing materials.

Unless the Customer elects to purchase the rental WEM, it should be returned complete with the original packaging materials to the address below at the end of the rental period. Return posting of the WEM is at the Customer's own risk and expense. For return purposes, proof of posting date is deemed to be the post-marked date on which the Customer sends the WEM back to the address below via Royal Mail Recorded Delivery. An optional facility is available online to report the date of posting and Royal Mail posting reference number.
